Mr Cunningham’s convict servants are assigned to him

Around this day, 1st January 1817, Mr Cunningham’s convict servants were assigned to him.
On his arrival in NSW in 1817 he was assigned one servant, Bartholomew Duffy,

who had come out in the “Surry” in 1816. Sometime after this Duffy was replaced by John Smith. 1
When Mr Cunningham died he bequeathed 1000 pounds to a John Smith. Was it the same John Smith who had been his body servant? 2
